Introduction and Mission Statement
At Mission National Bank (called "MNB" or "Bank"
herein), our mission is to address the financial needs of the
customers we serve. We want to offer you, our customers, the array
of financial products and services you need to accomplish your
financial goals. We recognize that trust is the basis for each of
our customer relationships, many of which span generations. As our
customer, you entrust us with sensitive financial information,
referred to in this Privacy Policy, as "Personal Information" (and
called "nonpublic personal information" and/or "personally
identifiable information" in applicable laws and regulations).
We honor the trust you place in Mission National
Bank and its staff, by making it a priority to treat your Personal
Information responsibly and by preserving its confidentiality. We
believe that the privacy of both current and former customers
should not be compromised, and have adopted this Privacy Policy
(called "Policy" herein) to help us achieve that important goal.
By explaining our Policy to you, we hope that you will better
understand how we keep your Personal Information private and
secure while we use it to provide you with the finest possible
service.
Security Procedures that Protect Personal
Information
MNB is committed to the security of your
Personal Information. We use a combination of physical, electronic
and procedural safe-guards that comply with federal standards, to
store your Personal Information and to secure it from unauthorized
and criminal access as well as from alteration or destruction. Our
operational and data processing systems function in a secure
environment, and our technical staff is trained to operate those
systems so as to maximize the protection of your Personal
Information. Our security standards are also supported by physical
and procedural safeguards that restrict access to your Personal
Information to those employees who require access to do their
work, and by providing those employees with intensive privacy
training.
MNB employees at all levels, especially those
who require access to your Personal Information, are held to the
very highest standards needed to ensure confidentiality. Employees
must follow the procedures for handling and protecting
confidential and proprietary information established in the Bank’s
Code of Business Conduct (called "Code" herein), which all
employees and other insiders (including the Board of Directors)
are required to sign. The Code reaffirms that your Personal
Information is private and privileged and that its use is
restricted to providing you with quality service. Employees who
violate the Bank’s privacy standards are subject to disciplinary
measures, up to and including termination.
Coverage and Notice of Changes in Our
Information-Sharing Practices
We provide our Privacy Policy to customers when
they open a new account and annually after that. However, this
Policy, and any subsequent revisions, will be available to
customers at any time upon request. If we change our policies with
respect to sharing your Personal Information in a way that is
inconsistent with this Policy, such as permitting disclosures to
additional types of parties, you will be notified in advance. If
required by law, we will also provide you with an opportunity to
"opt out" of such disclosure. This means that we will give you a
chance to refuse to permit the added disclosure, and that we will
allow a reasonable amount of time (usually 30 days) for you to
decline before we make any such disclosure.
This Policy applies to consumers who are
customers or former customers of MNB or of any affiliated
companies that, in the future, may provide financial services as
defined by applicable laws and regulations. No Personal
Information is presently shared with affiliates. The Personal
Information of former customers is not shared with affiliates or
with non-affiliated third parties except as may be required by
law. Such information is retained for the period required by
applicable regulations and is subsequently destroyed.

Management of Your Personal Information
MNB collects, retains and uses your Personal
Information when reasonably necessary and as permitted by law, in
order to conduct our business, provide you with our products and
services and administer related accounts and transactions, provide
you with superior service, and offer opportunities that we think
will be of interest to you and to our other customers. Because
your trust is our most important asset, the safekeeping of your
Personal Information has priority status in all of our business
operations.
Personal Information We Have About You
Personal Information is collected for specific
business purposes from a variety of sources. Information is
collected as a function of providing you with our products and
services. For example:
When you open an account, you provide us with
certain information, such as your name, address, phone number,
e-mail address, Social Security number, mother’s maiden name,
etc.
When you apply for credit, you provide us with
income data. We may also collect information from outside
sources, such as your credit history from a reputable consumer
reporting agency.
Once you have an account with us, we maintain
Personal Information about your transactions, such as account
balances and payment history, in order to administer your
account(s).
To improve our product and service offerings,
the Bank may collect data on an internal list that reflects your
activities and history with MNB. In addition, as part of our
efforts to reach new customers and to better serve existing
customers, the Bank may, at some future time, collect and use
outside information such as mailing lists from reputable sources.
Keeping Your Personal Information Accurate
and Up-to-Date
MNB follows procedures designed to ensure that
your Personal Information is accurate, current and complete, and
in keeping with reasonable commercial standards. If you identify
an inaccuracy in your Personal Information, or you need to change
or correct information, please notify us immediately. The Bank’s
staff will respond to your concerns and correct inaccuracies in a
timely manner.
Use of Your Personal Information
The Bank will use Personal Information only as
permitted by law and in accordance with the privacy principles set
forth in this Policy. Personal Information is used:
To protect and administer your records, accounts
and funds;
To help us identify and mitigate potential risks
or losses to MNB;
To comply with applicable laws and regulations;
To understand your financial needs; and
accordingly
To help us design and provide you with new and
improved products and services that our banking professionals
believe will do a better job of addressing your financial needs.
Sharing Information for Legal and Routine
Business Reasons and for Joint Marketing
MNB does not disclose Personal Information about
our customers or former customers to anyone except as permitted by
law. It is our policy to not reveal specific Personal Information
to non-affiliated third parties for their independent use, except
for the exchange of information with reputable information/credit
reporting agencies in order to maximize the accuracy and security
of such information or in the performance of bona fide corporate
due diligence and business matters. Nevertheless, you have a right
to know how we handle privacy issues with firms engaged in
business relationships with MNB. We require these parties
(generally the Bank’s vendors, suppliers, and service providers)
to enter into written contracts agreeing to safeguard our
customers’ Personal Information, and limiting its use to the
performance of the specific service(s) that the Bank has
requested.
MNB strictly limits the Personal Information it
shares with non-affiliated companies. The Bank does not disclose
Personal Information to these non-affiliated third parties,
unless:
You request or permit the information to be
shared.
Personal Information is disclosed to companies
that help the Bank process or service your financial
transactions or account(s), for example, companies that print
and mail your account statements. In such cases, the Bank only
shares the minimum amount of Personal Information required to
provide the product or service requested.
Personal Information (such as the fact that
you are a MNB customer) may be disclosed to a non-affiliated
financial institution with whom the Bank jointly markets, offers
or sponsors a bank product or service, for example, a credit
card product and the servicing of the related credit card
account. The contract(s) between the Bank and the other
financial institution must ensure the same high standard of
confidentiality that the Bank provides. Specifically, the
written contract(s) must prohibit the other financial
institution from re-disclosing or reusing any Personal
Information for its own purposes, require restricted access to
any Personal Information entrusted to its care, and limit its
use to the specific service(s) provided under the contract(s).
The Bank may disclose or report Personal
Information in limited circumstances when we believe in good
faith that disclosure is required or permitted under law, for
example, in the normal course of business to cooperate with
government agencies or law enforcement authorities, to resolve
consumer disputes, to perform credit/authentication checks, or
for institutional risk control.
The disclosure is legally required or
permitted by law, for example:
when litigation or legal process (such as a
subpoena) is involved; or
in an investigation of fraudulent activity; or
when requested by a bank regulator.
The Bank is involved in an acquisition or
sale.
MNB does not disclose Personal Information to
non-affiliated third-parties except as described above. MNB does
not provide account numbers or social security numbers to
affiliated or non-affiliated third parties except as may be
required by law, for example, due process such as a search
warrant, subpoena or other judicial process, or for data matches
required by the Office of Child Support Enforcement under the
Personal Responsibility Act of 1996.
Outside of these exceptions, MNB will not
share your Personal Information with non-affiliated third parties
unless you have specifically asked the Bank to do so. That is, you
have "opted in," OR the Bank has given you an opportunity to "opt
out" and you have not done so. Our overriding philosophy is to
serve our customers, not exploit them. We do not rent or sell your
Personal Information to third parties for their independent use.
MNB explicitly reserves the right to modify or
add terms to this Policy (and to its customer contracts) to
reflect its future election to disclose Personal Information not
presently disclosed, and to disclose such information to
affiliated companies or to additional categories of non-affiliated
parties. For example, Bank management might determine that
disclosure of customer names and addresses to an advertising or
public relations firm hired to market new products will benefit
the Bank and its customers. However, any such disclosure is
subject to giving you prior notice and an opportunity, as required
by law, to exercise your right to "opt out." That means your right
to direct the Bank not to make the proposed disclosures (other
than disclosures permitted by law). In that event, rest assured
